Försäljningsvillkor - konsumentköp

Inledning

Dessa försäljningsvillkor gäller mellan Karesuandokniven AB, 556949-4882 (nedan benämnt ”Karesuandokniven”, ”Oss” eller ”Vi”) och Dig som beställer en produkt från Oss (”Kunden”, ”Du” eller ”Dig”).

Genom att göra en beställning godkänner Kunden dessa Försäljningsvillkor (”Villkoren”) och åtar sig att efterleva dessa. Vi ber Dig därför att noggrant och med omsorg läsa igenom samtliga bestämmelser så att Du är fullt införstådd med Villkoren innan Du gör en beställning.

Vi förbehåller Oss rätten att ensidigt ändra dessa Villkor. Gällande Villkor återfinns alltid på www.karesuandokniven.com. Villkoren får inte ändras retroaktivt.

Villkoren gäller för de Kunder som är konsumenter, om Du representerar ett bolag eller annan juridisk person och vill beställa produkter från Oss, gäller andra villkor, kontakta Oss på info@karesuandokniven.com för att kunna ta del av våra försäljningsvillkor för juridiska personer. Produkter

Våra produkter framgår av vår webbplats inklusive vår webbshop, www.karesuandokniven.com (”Webbplats”). Vi reserverar Oss för att vissa produkter kan vara slutsålda även om de återfinns på Webbplatsen.

Beställningar

Beställning och bekräftelse

Beställningar görs via vår Webbplats. En bekräftelse på Kundens beställning skickas till den vid beställningen angivna e-postadressen, när ordern har hanterats. Vi behandlar ordrar så snabbt Vi kan, oftast samma vardag eller dagen efter. Om Du inte får någon bekräftelse måste Du höra av Dig till Oss på info@karesuandokniven.com för att säkerställa att ordern har tagits emot och hanterats.

Ålderskrav

För att göra en beställning måste Du vara minst 15 år eller ha din vårdnadshavares tillstånd att göra en beställning.

Beställning är bindande

Alla beställningar är bindande.

Neka beställning

Karesuandokniven förbehåller sig rätten att neka en Kund att få beställa och köpa en produkt.

Öppet Köp och returrätt

Standardprodukter i vårt ordinarie sortiment

Du har alltid rätt till 14 dagars öppet köp/returrätt om Du köper en standardprodukt, dvs en produkt som inte anpassas efter dina önskemål på något sätt.

Om Du har köpt en standardprodukt så gäller följande för din rätt att returnera/ångra ditt köp.

Du ska återsända produkten till Oss
Varje produkt måste returneras i originalförpackning och får inte vara skadad.
Kvitto eller kopia på faktura måste alltid medsändas.
Kunden betalar alltid returfrakten. Returer som skickas mot efterkrav/postförskott löses ej ut och räknas således inte som en korrekt retur.
För att köpet ska återgå måste produkten vara Oss tillhanda senast 14 dagar efter den dag då Du meddelat Oss om ditt beslut att utnyttja din ångerrätt.

Knivar eller andra produkter som tillverkas efter kunds önskemål såsom egen design, särskild gravyr eller andra specifika önskemål

Du har inte rätt till öppet köp, returrätt eller ångerrätt gällande produkter som tillverkas enligt Kundens önskemål, såsom design eller gravyr. Detta med stöd av 2:11 1 st 3 lag (2005:59) om distansavtal och avtal utanför affärslokaler (DAL) eftersom köpet ”avser en vara som har tillverkats enligt konsumentens anvisningar eller som annars har fått en tydlig personlig prägel”.

Priser

Gällande priser

Aktuella priser hittar Du alltid i på vår Webbplats.

Moms

Om inget annat tydligt framgår, anges samtliga priser inklusive svensk moms, för närvarande 12 eller 25 % beroende på vilken produkt Du beställer.

Reservation

Vi reserverar Oss för eventuella momshöjningar eller andra prisförändringar som Vi inte kan råda över.

Betalningsvillkor

Betaltjänster

Betalning sker via någon tredje parts betaltjänst såsom Shopify eller Klarna. Du kan också betala med andra tredjepartstjänster såsom Swish eller något betal- eller kreditkort. Exakt vilka betalmöjligheter Du har framgår av Webbplatsen.

Betalningen sker i enlighet med de villkor som tredje parten tillhandahåller. Vi ansvarar således inte för hur betalningen sker och villkoren för detta.

Leveranstid, leveranssätt och leveranskostnader

Leveranstid

Alla leveranstider är i arbetsdagar och inkluderar inte leverans på lördagar eller söndagar. Leveranstiderna som anges i kassan inkluderar inte bearbetning/produktionstid.

Alla paket måste skickas till fysisk adress.

Du kommer att få ett e-postmeddelande som bekräftar din beställning och efterföljande e-post(ar) kommer innehålla spårningsdetaljer när din beställning har skickats.

Även om vi gör allt vi kan för att för att säkerställa att din beställning levereras i tid, kan Karesuandokniven inte hållas ansvarig för förhållanden utanför vår kontroll, såsom hårt väder eller serviceavbrott hos våra leverantörer.

Ledtid

Ledtiden avser tiden mellan det att beställning läggs och det att den skickas. För kundanpassade och personliga produkter blir handläggningstiden längre.

Ledtiden kan variera från 2 till 10 arbetsdagar, men kan komma att ändras på grund av hög ordervolym under t.ex. semestertider under juli och december. Observera att arbetsdagar är måndag till fredag och utesluter helger och helgdagar.

Du kan kontrollera statusen för din beställning genom att kontakta kundsupport på Order@karesuandokniven.com (Öppettider 7.00-16.00 Måndag-torsdag)

Vi börjar arbeta med att fullfölja din beställning så fort den lagts.

Leveranssätt

Leveranser sker i enlighet med de villkor som den valda leverantören tillhandahåller.

Tredje parts ansvar för frakten

Vi är inte ansvariga för fel som begås av leverantören i form av fördröjd, felaktig eller utebliven leverans. Skulle problem uppstå kontaktar Du fraktbolaget direkt.

Fraktkostnader

Fraktkostnaden ingår inte i priset, utan frakt är endast en tjänst som Karesuandokniven förmedlar som en service till Dig som Kund – Du betalar frakten själv.

Fraktkostnaden är enligt respektive leverantörs taxa. Den exakta fraktkostnaden visas alltid när Du kommer till kassan, innan Du väljer att gå vidare och genomföra ditt köp. I fraktkostnaden ingår eventuell hemleverans och aviseringsavgifter.

Outlösta leveranser

Outlösta leveranser debiteras med 500 SEK. Kostnaden faktureras i efterskott.

Ansvar för fel i produkt och reklamation

Ursprungliga fel eller andra fel som beror på Karesuandoknivens tillverkning

Karesuandokniven ansvarar för ursprungliga fel på produkten i tre år från inköpstillfället.

Reklamation

Kunden ska reklamera inom skälig tid, dock senast tre månader, från att felet upptäcktes. Reklamation ska ske skriftligen eller mejlledes till adress som anges nederst under Kontaktinformation och bolagsinformation.

Om Kunden borde ha märkt felet tidigare så gäller reklamationsfristen på tre månader från den tidpunkt då Kunden borde ha märkt felet. Därefter har Du inte rätt att reklamera.

Påföljder vid fel i produkt

Våra skyldigheter

Vi är skyldiga att åtgärda felet genom att antingen

reparera felet,
byta till en ny, felfri produkt,
ge Kunden ett prisavdrag som motsvarar felet eller
ersätta Dig för den faktiska och skäliga kostnaden om Du ombesörjer reparation på egen hand.

Skadestånd eller innehållande av betalning

Du kan ha rätt till skadestånd på grund av felet i enlighet med Konsumentköplagen (2022:260).

Du har rätt att hålla inne betalningen under den tid Vi åtgärdar felet.

Hävning

Du har rätt att häva köpet om felet är av betydelse för Dig.

Tidsfrist för åtgärdande

Vi är skyldiga att åtgärda felet inom skälig tid från det att Du reklamerat på korrekt sätt enligt Reklamation. Tidsåtgången för vårt åtgärdande är beroende på typ av fel. Vi gör vårt bästa för att åtgärda felet så snart som möjligt.

Transport efter reklamation

Du ansvarar för att återsända den felaktiga produkten till Oss, och Du ansvarar även för att förpacka produkten så att den inte skadas under transporten.

Immateriella rättigheter

Upphovsrätt och varumärkesrätt

Alla immateriella rättigheter, såsom upphovsrätt och varumärkesrätt, på Webbplatsen och i relation till våra produkter, tillhör uteslutande Karesuandokniven eller andra bolag i koncernen.

All användning av Webbplatsen och dess innehåll, inklusive kopiering och lagring av sådant innehåll i dess helhet eller delar därav är förbjudet för andra ändamål än för icke-kommersiella ändamål och personligt bruk.

Särskilt gällande varumärken

Varumärken (t.ex. ordmärken, logotyper m.m.) som visas på Webbplatsen är registrerade eller oregistrerade varumärken vilka samtliga ägs och innehas av Karesuandokniven. Ditt användande av Webbplatsen ska inte förstås som en direkt eller indirekt licens eller rättighet att använda något av Karesuandoknivens varumärken, om inte annat har skriftligen avtalats mellan Kunden och Karesuandokniven.

Personuppgifter

När Du beställer en produkt innebär detta att Karesuandokniven kommer att behandla de personuppgifter (dina kontaktuppgifter såsom för- och efternamn, adress, mejladress och mobilnummer) som anges vid registreringen. Vi behandlar dina personuppgifter i enlighet med vår integritetspolicy https://karesuandokniven.com/pages/gdpr för att kunna genomföra din beställning och för att kunna marknadsföra andra produkter till Dig.

Den rättsliga grunden för vår behandling av dina personuppgifter är fullgörande av avtal med Dig, och för att kunna marknadsföra Oss gentemot Dig så är den rättsliga grunden intresseavvägning.

Klausulers giltighet

Om en eller flera bestämmelser i dessa Villkor är ogiltiga eller döms ut såsom verkningslösa av domstol eller myndighet, ska detta inte inverka på återstående bestämmelsers giltighet.

Fullständig reglering

Dessa Villkor jämte vår integritetspolicy https://karesuandokniven.com/pages/gdpr utgör hela avtalet mellan Karesuandokniven och Kunden, och ersätter samtliga muntliga och/eller skriftliga tidigare överenskommelser och avtal mellan parterna.

Tillämplig lag och tvistlösning

Svensk rätt

Svensk rätt ska tillämpas på villkoren eller sådana krav, tvister eller andra frågor som uppkommer med anledning av tolkning eller tillämpning av Villkoren.

Tvist

Om tvist riskerar att uppkomma ska parterna i första hand försöka lösa tvisten genom medling och i god anda. I andra hand ska tvister som uppstår i anledning av dessa Villkor avgöras av Uppsala tingsrätt.

Du kan också välja att anmäla Oss till Allmänna reklamationsnämnden om Karesuandokniven, enligt Dig, inte hanterat ditt ärende på ett korrekt sätt. Se Konsument | Allmänna reklamationsnämnden (arn.se)

Terms of sale - consumer purchases

Introduction

These terms and conditions of sale apply between Karesuandokniven AB, 556949-4882 (hereinafter referred to as "Karesuandokniven", "Us" or "We") and You who order a product from Us ("Customer" or "You").

By placing an order, the Customer accepts these Terms of Sale (the "Terms") and undertakes to comply with them. We therefore ask You to carefully and carefully read all the provisions so that You are fully aware of the Terms before placing an order.

We reserve the right to unilaterally change these Terms. The applicable Terms and Conditions can always be found on www.karesuandokniven.com. The Terms may not be changed retroactively.

The terms apply to those Customers who are consumers, if You represent a company or other legal entity and want to order products from Us, other terms apply, contact Us at info@karesuandokniven.com to be able to take part of our terms of sale for legal entities.

Products

Our products are displayed on our website including our webshop, www.karesuandokniven.com ("Website"). We reserve the right that some products may be sold out even if they can be found on the Website.

Orders

Order and confirmation

Orders are placed through our Website. A confirmation of the Customer's order will be sent to the e-mail address provided when the order has been processed. We process orders as quickly as We can, usually the same weekday or the day after. If You do not receive a confirmation, You must contact Us at info@karesuandokniven.com to ensure that the order has been received and handled.

Age requirements

To place an order, You must be at least 15 years old or have your guardian's permission to place an order.

Order is binding

All orders are binding.

Decline order

Karesuandokniven reserves the right to deny a Customer the right to order and purchase a product.

Open purchase and return policy

Standard products in our regular range

You are always entitled to a 14-day open purchase/return policy if You buy a standard product, ie a product that is not adapted to your wishes in any way.

If You have purchased a standard product, the following applies to your right to return/cancel your purchase.

You must return the product to Us
Each product must be returned in its original packaging and must not be damaged.
A receipt or copy of the invoice must always be sent.
The customer always pays the return shipping. Returns sent using cash on delivery/collect on delivery can not be redeemed and thus do not count as a correct return.
In order for the purchase to return, the product must be received by Us no later than 14 days after the day on which You notified Us of your decision to exercise your right of withdrawal.

Repentance form

There is also more information about your right of withdrawal. If You wish, You can use the Swedish Consumer Agency's cancellation form which You can find here: Cancellation form (konsumentverket.se), there is also more information about your right to cancel.

Knives or other products manufactured according to customer requirements such as own design, special engraving or other specific requests

You are not entitled to open purchase, return or cancellation for products manufactured according to the Customer's wishes, such as design or engraving. This is based on 2:11 1 st 3 Act (2005:59) on distance contracts and off-premises contracts (DAL) because the purchase "concerns a product that has been manufactured according to the consumer's instructions or that has otherwise been given a clear personal touch".

Current prices can always be found on our Website.

VAT

Unless otherwise clearly stated, all prices include Swedish VAT, currently 12 or 25% depending on the product You order.

Reservation

We reserve the right for any VAT increases or other price changes that We cannot control.

Payment terms

Payment services

Payment is made via any third party payment service such as Shopify or Klarna. You can also pay with other third-party services such as Swish or any debit or credit card. Exactly what payment options You have is stated on the Website.

Payment is made in accordance with the conditions provided by the third party. We are therefore not responsible for how the payment is made and the conditions for this.

Delivery time, delivery method and delivery costs

Shipping Time

All shipping times offered are in business days and do not include Saturday or Sunday delivery. The shipping times listed at checkout do not include processing/production time. 

All packages must be shipped to a physical address.

You will receive an email confirming your order, and subsequent email(s) with tracking details when your order has shipped. 

While we will do all we can to ensure your order is delivered on time, Karesuandokniven cannot be held responsible for conditions beyond our control such as severe weather or service disruptions.

Processing Time

Processing time refers to the time between when the order is placed and when it is shipped. For custom and personalized products, the processing time will be longer.

Processing times can range from 2 to 10 business days, but are subject to change because of high order volume during our holiday season throughout July and December. Please note that business days are Monday through Friday and exclude weekends and holidays. 

Checking Your Order Status

You can check the status of an order by contacting customer support at order@karesuandokniven.com (monitored 7 a.m. to 4 p.m. CET Monday-Thursday).

We start working on fulfilling your order as soon as it is placed.

Shipping costs

The shipping cost is not included in the price, but shipping is only a service that Karesuandokniven conveys as a service to You as a Customer – You pay the shipping yourself.

The shipping cost is according to the respective supplier's tariff. The exact shipping cost is always shown when You arrive at checkout before You choose to proceed and complete your purchase. The shipping cost includes any home delivery and notification fees.

Unredeemed deliveries

Unredeemed deliveries will be charged with 500 SEK. The cost is invoiced in arrears.

Liability for defects in product and complaint

Original or other defects due to the manufacture of Karesuandokniven

Karesuandokniven is responsible for original defects in the product for three years from the time of purchase.

Complaint

The customer must make a complaint within a reasonable time, but no later than three months, from the discovery of the defect. Complaints must be made in writing or by email to the address specified under Contact information and company information.

If the Customer should have noticed the error earlier, the complaint period of three months applies from the time when the Customer should have noticed the error. After that, You do not have the right to make a complaint.

Penalties in case of defect in product

Our obligations

We are obliged to rectify the error by either:

repair the error,
change to a new, fault-free product,
give the Customer a price reduction corresponding to the defect, or
reimburse You for the actual and reasonable cost if You arrange repair on your own.

Damages or withholding of payment

You may be entitled to compensation due to the error in accordance with the Consumer Purchase Act (2022:260).

You have the right to withhold payment for the time We rectify the error.

Cancellation

You have the right to cancel the purchase if the error is of importance to You.

Time limit for remediation

We are obliged to rectify the error within a reasonable time from the time You have complained in the correct manner according to Complaint. The time required for our correction depends on the type of error. We will do our best to fix the error as soon as possible.

Transport after complaint

You are responsible for returning the faulty product to Us, and You are also responsible for packaging the product so that it is not damaged during transport.

Immaterial rights

Copyright and trademark rights

All intellectual property rights, such as copyright and trademark rights, on the Website and in relation to our products, belong exclusively to Karesuandokniven or other companies in the Group.

Any use of the Website and its content, including copying and storing such content in whole or parts thereof, is prohibited for purposes other than non-commercial purposes and personal use.

Especially regarding trademarks

Trademarks (e.g. word marks, logos, etc.) displayed on the Website are registered or unregistered trademarks, all of which are owned and held by Karesuandokniven. Your use of the Website shall not be understood as a direct or indirect license or right to use any of Karesuandokniven's trademarks, unless otherwise agreed in writing between the Customer and Karesuandokniven.

Personal data

When You order a product, this means that Karesuandokniven will process the personal data (your contact details such as first and last name, address, email address and mobile number) provided during registration. We process your personal data in accordance with our privacy policy https://karesuandokniven.com/pages/gdpr in order to complete your order and to be able to market other products to You.

The legal basis for our processing of your personal data is the fulfillment of an agreements with You, and in order to market Us to You, the legal basis is balancing of interests.

Validity of clauses

If one or more provisions of these Terms and Conditions are invalid or rendered ineffective by a court or authority, this shall not affect the validity of the remaining provisions.

Full regulation

These Terms together with our privacy policy https://karesuandokniven.com/pages/gdpr constitute the entire agreement between Karesuandokniven and the Customer, and supersede all oral and/or written prior agreements and agreements between the parties.

Applicable law and dispute resolution

Swedish law

Swedish law shall apply to the Terms and Conditions or such claims, disputes or other issues that arise due to the interpretation or application of the Terms.

Dispute

If there is a risk of a dispute, the parties shall primarily try to resolve the dispute through mediation and in good spirit. In the alternative, disputes arising in connection with these Terms and Conditions shall be settled by Uppsala District Court.
